Do OnlyFans or Fansly Keep Your 2257 Records for You?

The short answer

No. A platform keeps 2257 records for its own role. It does not keep yours. If you film or photograph sexually explicit content, of yourself or of anyone else, you are the primary producer of that content, and the records for it are your responsibility.

Why the platform's records are not your records

18 U.S.C. 2257 applies to whoever produces the content, and the regulations split producers in two. The primary producer shoots it. The secondary producer publishes, reproduces or manages it, for example on a website. When you post on OnlyFans or Fansly, you are the primary producer and the platform is a secondary producer. Each one carries its own record-keeping duty.

The regulations let a secondary producer rely on copies of the primary producer's records. That permission runs in one direction only. Nothing in them lets a primary producer rely on the platform's records instead of keeping its own.

What the platform's ID check gives you, and what it does not

Platforms verify a creator's identity and age when the account is set up, and they ask for paperwork when another person appears in your content. That check is real. It is the platform's compliance, kept by the platform's custodian at the platform's address.

What it does not give you:

  • A record you can produce yourself if your records are requested
  • A 2257 statement for your content, with a custodian name and a street address
  • Records that follow your content when you post it anywhere else

The test: what moves with you

Post the same clip on two platforms, or leave one platform for another, and the platform's records stay where they are. Your records have to travel with your content. You cannot ask a platform to hand over its records as yours.

What your records need to hold

For every performer in a piece of content, including you:

  • Legal name and date of birth, from a picture ID you examined before the shoot, plus a legible copy of that ID
  • Every other name the performer has used, stage names included
  • A copy of the content and the URL where it is published
  • The date of original production
  • An index that links each performer to every piece of content they appear in

Your content also needs a 2257 statement giving a street address where the records can be made available. A post office box does not count.
