Custodian of Records Agreement

1. Who this agreement is between

This agreement is between Website Design Company LLC, which operates Easy2257 ("Easy2257", "we", "us"), and you, the holder of the Easy2257 account that accepts it ("you"). It sits alongside the Easy2257 Terms of Service and applies to the records you create or receive on the Service.

2. The designation

You designate Easy2257 as your non-employee custodian of records under 28 C.F.R. 75.2(h) for the records required by 18 U.S.C. 2257 and 28 C.F.R. Part 75 that you submit to the Service, and Easy2257 accepts that designation.

The regulation says what this does and does not do, and we repeat it here in its own terms: a producer may contract with a non-employee custodian to retain copies of the required records; the custodian must comply with all obligations related to those records; and such a contract does not relieve the producer of his liability under Part 75.

3. What Easy2257 will do

Retain copies of the records you submit, organised and cross-referenced as 28 C.F.R. 75.2(a)(3) requires, for the period 28 C.F.R. 75.4 requires: seven years from the date of creation or last amendment or addition, and, if you cease to carry on the business, five years thereafter. The Terms of Service describe the same window.

Hold a copy of each depiction you record with us, in the reduced form you supply at the time you record it, as 28 C.F.R. 75.2(a)(1)(iii) requires, for the same period as the rest of the record, and produce it with the record.

Publish, at a permanent address you can place with your content, the statement 18 U.S.C. 2257 requires, naming Easy2257 as the custodian and giving the records address.

Make the records we hold for you available for inspection at the records address as 28 C.F.R. 75.5 provides, and receive and handle an inspection request that concerns those records, so that a platform or a law enforcement agency asking for them can be referred to Easy2257. If we receive an inspection request or demand that concerns records we hold for you, we will tell you, to the extent the law allows us to.

Produce your complete records to you on request, and transfer them to a successor custodian you designate, as the Terms of Service describe.

Issue you a signed designation record (section 6) and keep it verifiable for as long as we hold your records.

4. What stays yours

You remain the producer. You are responsible for the truth and completeness of every record and every statement you submit; for examining the identification documents where the examination attestation applies, or for holding copies received from a primary producer where the received-records attestation applies; for placing the statement where 28 C.F.R. 75.6 and 75.8 require it; and for every other obligation Part 75 places on a producer. Easy2257 records what you submit and does not verify it unless a feature says in plain words that it does.

5. Records address

The records address is the address shown on your published statement and on your signed designation record. If it changes, we update the published statement, and the address on your statement page is always the current one; your statement link does not change.

6. The signed designation record

When a paid relationship with you first exists after you accept this agreement, Easy2257 issues a signed designation record: a statement, signed with the same key that signs our production certificates and verifiable by anyone at easy2257.com, that you designated Easy2257 as custodian on a given date and that we accepted. It names this agreement's version and our identity. It carries no performer data and no document contents.

The record has no expiry. Its standing is reported from our records, not from the token: it stays current unless we mark it revoked, and we mark it revoked only when your complete records have been transferred to a successor custodian.

7. How long this lasts

This agreement begins when you accept it and continues for as long as Easy2257 holds any of your records within the retention period, whether or not you keep a paid subscription. Records within the retention period remain in custody regardless of subscription status, as the Terms of Service state. The agreement ends when your complete records have been transferred to a successor custodian you designate, or when the retention period for the last record we hold has passed and the record has been purged.

8. Platform partners

If you reached Easy2257 through a platform partner, that platform may have its own agreement with Easy2257 covering the platform's statement and its obligations. This agreement is between you and Easy2257 only, and nothing in a platform agreement reduces what we owe you under it.

9. Changes

If we change this agreement in a way that matters, we will tell you through the Service and ask you to accept the new version the next time you visit the custodian pages; until you do, the version you accepted stands. Each version you accept is recorded with its date and a fingerprint of its exact text.

10. Governing law

This agreement is governed by the laws of Arizona, United States, and any dispute under it is resolved in the courts of Arizona, the same as the Terms of Service.
